Welcome to PorchPickups.com (the "Platform"), operated by Thrift Trader LLC DBA PorchPickups.com ("PorchPickups," "we," "us," or "our"), a limited liability company organized under the laws of the State of Oklahoma.
By accessing or using the Platform, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use PorchPickups. By creating an account, you represent and warrant that you meet these requirements. We reserve the right to request proof of age or identity at any time and to suspend or terminate accounts that do not meet eligibility criteria.
2. Account Registration and Security
- You must provide accurate, current, and complete information during registration, including your name, email address, zip code, city, and state.
- You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to notify us immediately at admin@PorchPickups.com of any unauthorized access or use of your account.
- PorchPickups reserves the right to suspend, disable, or delete any account at our sole discretion, with or without notice, for any conduct that we determine to be in violation of these Terms or harmful to other Users or the Platform.
3. Platform Description
PorchPickups is an online marketplace and social auction platform that connects buyers and sellers of primarily pre-owned, secondhand, vintage, collectible, and consignment goods. The Platform provides:
- Classic Auctions — Timed online auctions with real-time bidding and countdown timers.
- Live Auction Events — Seller-hosted live video streams where items are auctioned in real time.
- Social Features — User profiles, seller following, activity feeds, watchlists, and community engagement tools.
- Communication Tools — Direct messaging between buyers and sellers, in-app notifications, push notifications, and email notifications.
PorchPickups acts solely as an intermediary platform. We are not a party to any transaction between buyers and sellers. We do not take possession of, inspect, authenticate, appraise, or guarantee any item listed on the Platform.
4. User Roles and Responsibilities
4.1 Buyers
- All bids placed on the Platform are binding offers to purchase. You may not retract a bid once placed unless the listing is materially altered by the seller after your bid.
- If you are the winning bidder, you are obligated to complete payment within the timeframe specified in the listing or by the Platform (typically 48 hours).
- 14-Day Fulfillment Deadline: Buyers have 14 days from the date of sale to complete payment and pick up or arrange shipping for won items. Sellers may extend this deadline at their discretion. Failure to fulfill within the deadline may result in order cancellation by the seller.
- Auto-Refund on Cancellation: If an order is cancelled by the seller and a card payment has been made, the payment will be automatically refunded to the buyer's card on file.
- Failure to pay for won items may result in account suspension, negative account standing, and/or permanent ban from the Platform.
- You are responsible for inspecting item descriptions, photos, and any disclosed conditions before bidding. All items are sold "as-is" unless otherwise stated by the seller.
- Cancellation Policy: Buyer accounts with a cancellation or non-payment rate exceeding 15% will be flagged for review. Flagged accounts are subject to a temporary hold on all bidding and purchasing activities until a manual review is completed by PorchPickups.
- Sales Tax: Applicable sales tax is automatically calculated and added to all card transactions at checkout based on your location. For cash-at-pickup transactions, sales tax collection is at the discretion of the seller in accordance with applicable state and local law. Buyers should be prepared to pay sales tax on cash transactions if requested by the seller.
- Reporting: Buyers may report sellers for misconduct, including but not limited to items not as described, failure to make items available for pickup, and unresponsive communication. All reports are reviewed by PorchPickups and may result in account warnings or restrictions for the reported party.
- Quick Picker-Upper Badge: Buyers who consistently pick up items promptly may earn the "Quick Picker-Upper" badge. To earn and keep this badge, you must have completed at least 3 orders and picked up 80% or more of your orders within 7 days of the sale date. The badge is automatically applied when these criteria are met and automatically removed if your pickup rate falls below 80%. Maintaining prompt pickups helps build trust with sellers across the platform.
- Structured Pickup Windows & No-Shows: When bidding on a pickup-eligible listing, you acknowledge the seller's published pickup windows and address (see Section 7.2). Failure to appear during a confirmed pickup window without prior notice may be recorded as a no-show, will impact your public pickup reliability percentage and 30-day no-show count, and may result in being blocked by individual sellers or losing buying privileges.
- Ratings: Buyers and sellers may rate each other after a transaction. Star ratings update aggregate metrics on your profile in real time; written comments are subject to a 24-hour cooldown before being publicly visible (see Section 7.3).
4.2 Sellers
- You must accurately and honestly describe all items listed for auction, including condition, defects, dimensions, brand, and authenticity to the best of your knowledge.
- You represent and warrant that you have legal ownership or authority to sell all listed items, and that the sale does not violate any applicable law.
- You are solely responsible for fulfilling orders, including packaging, shipping, and handling, within the timeframes communicated to the buyer.
- You agree to pay all applicable platform fees as displayed at the time of listing or sale. Fees are subject to change with reasonable notice.
- Payment Processing Fees: For card transactions, Stripe's payment processing fee (2.9% + $0.30 per transaction) is deducted from the seller's payout. Platform commission is not collected at the time of card payment — it accrues in the seller's commission ledger and is settled separately (see "Commission Policy" and "Commission Auto-Draft" below). Processing fees do not apply to cash-at-pickup transactions.
- Commission Policy: A platform commission is owed upon auction completion (when a winner is determined), regardless of whether the order is subsequently cancelled. Commission accrues in the seller's commission ledger as items sell, and is paid by the seller — either manually (subject to a $25 minimum balance) or via automatic drafting from the card on file (see "Commission Auto-Draft"). Commission is non-refundable unless the item is relisted on PorchPickups and successfully resold, in which case the original commission is credited and a new commission applies to the resale. Deleting a cancelled order without relisting forfeits any commission credit.
- Commission Auto-Draft: By accepting selling privileges, you consent to automatic drafting of owed commissions from your card on file when your ledger balance reaches $50. Manual commission payments are also available once your balance reaches $25 or more. If an auto-draft charge is declined, your account will be restricted — all active listings will be cancelled and bidding rewards suspended — until the balance is paid.
- Cash-Only Sellers: Sellers may opt in to cash-only selling, which restricts all listings to local pickup only with no shipping options. Cash-only sellers are not required to connect a Stripe Express account for payouts but must maintain a card on file for commission payments. All listings from cash-only sellers are clearly marked as "Cash Only."
- Cancellation Policy: Accounts with a cancellation rate exceeding 15% will be flagged for review. Flagged accounts are subject to a temporary hold on all buying and selling activities until a manual review is completed by PorchPickups. Repeated or excessive cancellations may result in permanent account restrictions.
- Order Cancellation: Sellers may cancel an order by selecting a structured cancellation reason. If the buyer paid by card, a full refund is automatically issued. Sellers may optionally report the buyer during cancellation for non-payment or failure to pick up.
- Reporting: Sellers may report buyers for misconduct, including but not limited to non-payment, failure to pick up, and inappropriate behavior. All reports are reviewed by PorchPickups and may result in account warnings or restrictions for the reported party.
- Sellers must comply with all applicable federal, state, and local laws regarding the sale of secondhand goods, including but not limited to consumer protection, product safety, and tax obligations.
- Sellers who receive card payments through Stripe will receive a 1099-K from Stripe at the end of each tax year once they meet or exceed the IRS reporting threshold for gross card transaction volume. It is the seller's responsibility to report this income and consult a tax professional regarding their filing obligations.
- Sales tax on card transactions is calculated and collected by the Platform on behalf of sellers. For cash-at-pickup transactions, the seller is responsible for collecting and remitting sales tax at their discretion and in accordance with applicable state and local tax laws. PorchPickups does not calculate, collect, or remit sales tax on cash transactions. Failure to comply with applicable tax obligations is solely the seller's responsibility.
- Shipping Beta: Offering shipping on listings is currently restricted to sellers who have been approved by PorchPickups for the shipping beta. Approved sellers may purchase real carrier labels through our Shippo integration and are responsible for accurate package details, timely drop-off, and providing tracking (see Section 7.1). Sellers not enrolled in the beta must list items as local-pickup only.
- Pickup Windows: Sellers offering local pickup must publish one or more structured pickup windows (specific date and time ranges) and a pickup address at the time of listing. Free-text or open-ended pickup terms on new listings are not permitted (see Section 7.2).
- Blocking Buyers: Sellers may block individual buyers from bidding on their listings for a stated reason (e.g., non-payment, no-show, abusive behavior). Block reasons are private. Abuse of the blocking system, or buyers being blocked by five (5) or more independent sellers, may trigger administrative review (see Section 7.4).
4.3 All Users
- You agree not to use the Platform for any unlawful purpose, including the sale of stolen, counterfeit, hazardous, recalled, or prohibited items.
- You agree not to engage in shill bidding (bidding on your own items or coordinating bids to artificially inflate prices).
- You agree not to harass, threaten, defame, or abuse other Users through any feature of the Platform.
- You agree not to use bots, scripts, scrapers, or automated tools to access or interact with the Platform without express written consent.
- You agree not to circumvent or attempt to circumvent Platform fees, payment processing, or communication systems (e.g., by conducting transactions off-platform to avoid fees).
5. Prohibited Items
The following items may not be listed or sold on PorchPickups:
- Firearms, ammunition, explosives, or weapons of any kind
- Controlled substances, drugs, drug paraphernalia
- Stolen property
- Counterfeit or replica goods represented as authentic
- Hazardous materials or recalled products
- Items that infringe on intellectual property rights (copyright, trademark, patent)
- Sexually explicit or obscene material
- Live animals
- Human remains or body parts
- Any item whose sale is prohibited by federal, state, or local law
PorchPickups reserves the right to remove any listing and suspend any account associated with prohibited items without notice.
6. Fees, Payments, and Commission
- PorchPickups charges sellers platform fees as displayed on the Platform at the time of each transaction. Fee schedules are available within the seller dashboard and may be updated from time to time.
- All payments between buyers and sellers are processed through Stripe, our third-party payment processor. By using PorchPickups, you also agree to Stripe's Terms of Service.
- PorchPickups does not store your full credit card or bank account information. Payment data is handled entirely by Stripe in compliance with PCI-DSS standards.
- Sellers may opt to accept cash payment at local pickup. Such transactions are between the buyer and seller; PorchPickups bears no responsibility for cash transactions.
- Sales tax is automatically calculated and added to all card transactions based on the buyer's and seller's locations. Buyers are responsible for paying the applicable sales tax at checkout. For cash-at-pickup transactions, sales tax may be collected by the seller at their discretion in accordance with applicable law.
- Refunds, disputes, and chargebacks are handled in accordance with Section 9 of these Terms.
7. Shipping and Local Pickup
7.1 Shipping (Beta Program)
- Beta Access: The shipping feature is currently offered as an opt-in beta program. Only sellers who have been approved by PorchPickups for the shipping beta may enable shipping options on their listings. Sellers who have not been approved are restricted to local pickup only and may not display, offer, or charge for shipping under any circumstances.
- Shippo Integration: Shipping rates, label purchases, and tracking are facilitated through our third-party logistics partner, Shippo. By enabling shipping on a listing, sellers also agree to Shippo's Terms of Service. Shipping labels are real, paid carrier labels (USPS, UPS, FedEx, etc.) and are non-refundable once printed except as permitted by the carrier.
- Seller Responsibilities: Sellers must accurately disclose package weight and dimensions, select an appropriate carrier and service, purchase the shipping label promptly after payment, drop off the package within the timeframe communicated to the buyer, and provide valid tracking information. Inaccurate weights or dimensions may result in carrier adjustment fees, which are the seller's responsibility.
- Shipping Costs: Shipping costs are paid by the buyer at checkout in addition to the item price and applicable taxes. Shipping costs are non-refundable once a label has been generated, unless the order is cancelled before label purchase.
- Lost, Damaged, or Delayed Packages: PorchPickups is not responsible for items lost, damaged, stolen, or delayed in transit. Carrier insurance claims and disputes are the responsibility of the seller and buyer to pursue with the carrier directly. PorchPickups may, at its discretion, assist in mediating such disputes but assumes no liability.
- Tracking and Delivery: Sellers must mark orders as shipped and provide tracking numbers within the Platform. Delivery confirmation events received via Shippo webhooks are recorded by the Platform and may be used to update order status and resolve disputes.
7.2 Local Pickup — Structured Pickup Windows
- Defined Pickup Windows: Sellers offering local pickup must define one or more structured pickup windows (specific date and time ranges) and a pickup address (street, city, state, ZIP) at the time of listing. Free-text or vague pickup terms are no longer permitted on new listings.
- Buyer Commitment: Bidding on a pickup-eligible listing constitutes the buyer's acknowledgment that they are reasonably available during one or more of the seller's published pickup windows. Buyers are responsible for arranging pickup within those windows or coordinating an alternative directly with the seller.
- No-Show Tracking: If a buyer fails to appear during a confirmed pickup window without prior notice, the seller may flag the order as a no-show via the cancellation flow or post-sale rating. No-shows are recorded against the buyer's account and contribute to a 30-day rolling no-show count and a pickup reliability percentage displayed on the buyer's profile.
- Reliability Consequences: Buyers with elevated no-show counts or low pickup reliability may be flagged for review, lose access to the Quick Picker-Upper badge, be blocked by individual sellers (see Section 7.4), or, in severe cases, have buying privileges suspended or terminated by PorchPickups.
- Safety: Buyers and sellers are responsible for coordinating safe pickups. PorchPickups strongly recommends meeting in public, well-lit areas, bringing a friend, and following local safety guidance. PorchPickups is not a party to the pickup encounter and assumes no liability for incidents that occur during pickup.
7.3 Two-Way Ratings & Reviews
- Mutual Rating System: After a transaction is completed (or cancelled in certain cases), both parties may rate each other. Buyers rate sellers on item accuracy, communication, and overall experience. Sellers rate buyers and may indicate whether the buyer "showed up" and was "on time" for pickup.
- Star Ratings & Comments: Ratings consist of a 1–5 star score and an optional written comment. Aggregate star ratings (seller average, buyer average, pickup reliability percentage) are visible on user profiles and update in real time as ratings are submitted.
- 24-Hour Comment Cooldown: The written portion of any rating is hidden from public view for 24 hours after submission to allow both parties an opportunity to resolve issues directly. Aggregate metrics are not affected by this cooldown.
- Rating Conduct: Ratings and comments must be truthful, relevant to the transaction, and free of profanity, threats, harassment, personal attacks, or unrelated content. PorchPickups reserves the right to remove or redact any rating or comment that violates these Terms or our community standards.
- No Manipulation: Soliciting, exchanging, or paying for positive ratings, retaliating against a counterparty for an honest rating, or attempting to manipulate the rating system in any way is strictly prohibited and may result in account suspension or termination.
7.4 Seller Blocking of Buyers
- Right to Block: Sellers may block individual buyers from bidding on their listings. A blocked buyer will be unable to place bids on any current or future listing from the blocking seller for as long as the block remains in place.
- Reasons: Sellers must select or provide a reason when blocking a buyer (e.g., non-payment, no-show, abusive communication, repeated cancellations). Block reasons are private to the seller and PorchPickups administrators and are not shown to the blocked buyer.
- Removal: Sellers may remove a block at any time from their seller dashboard. PorchPickups may, at its sole discretion, remove a block in cases of abuse of the blocking system.
- Platform-Level Review: If a buyer is blocked by five (5) or more independent sellers, the buyer's account is automatically flagged for administrative review. PorchPickups may, after review, issue warnings, place restrictions on, suspend, or terminate accounts that demonstrate a pattern of conduct harmful to sellers or the marketplace.
- Not a Substitute for Reporting: Blocking does not replace the right (or, in serious cases, the obligation) of either party to report misconduct to PorchPickups for formal review under Section 9.
8. Condition of Goods; No Warranty
Items sold on PorchPickups are primarily pre-owned, used, vintage, or secondhand goods. Unless explicitly stated otherwise by the seller:
- All items are sold "AS-IS, WHERE-IS" with no express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- PorchPickups does not authenticate, verify, inspect, or guarantee the condition, quality, safety, legality, or accuracy of any listing or item.
- Buyers bid and purchase at their own risk and are encouraged to thoroughly review all listing details and photos before bidding.
9. Disputes, Cancellations, and Refunds
- PorchPickups encourages buyers and sellers to resolve disputes directly through the Platform's messaging system.
- If a resolution cannot be reached, either party may contact PorchPickups support at admin@PorchPickups.com for mediation assistance. PorchPickups may, at its sole discretion, facilitate refunds, cancellations, or other resolutions.
- Structured Cancellations: When a seller cancels an order, they must select a cancellation reason (e.g., buyer didn't pay, paid but not picked up, buyer changed mind, item damaged or unavailable, mutual agreement, or other). A detailed explanation may also be provided.
- Automatic Refunds: If a buyer has paid for an item by card and the order is cancelled for any reason, the card payment is automatically refunded in full. Cash transactions are handled between the buyer and seller.
- Commission on Cancellation: Platform commissions remain owed upon cancellation and are non-refundable. If the seller relists the item and it resells on the Platform, the original commission is credited and a new commission applies at the resale price. If the seller chooses to delete the cancelled order without relisting, the original commission remains owed.
- User Reporting: Both buyers and sellers may report each other for misconduct through the Platform. Reports require a reason category and written details, and are submitted for admin review. Reports may result in account warnings, temporary holds, or permanent restrictions at the discretion of PorchPickups.
- PorchPickups reserves the right to cancel any transaction, issue refunds, or reverse payments if we determine that a violation of these Terms has occurred, including but not limited to fraudulent activity, prohibited items, or misrepresentation.
- Sellers who experience excessive cancellations, disputes, or refund requests may be subject to account restrictions or termination.
10. Intellectual Property
- All content on the Platform — including but not limited to the PorchPickups name, logo, design, software, text, graphics, and user interface — is the property of Thrift Trader LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
- By uploading photos, descriptions, or other content to the Platform, you grant PorchPickups a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute such content in connection with operating and promoting the Platform.
- You represent that you own or have the necessary rights to all content you upload and that it does not infringe on the rights of any third party.
11. Privacy and Data
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and disclose your personal information. By using PorchPickups, you consent to the practices described in our Privacy Policy.
12. Push Notifications and Email Communications
- By creating an account, you consent to receive transactional emails related to your account activity (bids, wins, password resets, order updates).
- You may opt in to push notifications and marketing emails (such as the daily auction digest). You can manage your notification preferences at any time in your Notification Settings.
- You may unsubscribe from non-transactional emails at any time. Transactional emails necessary for account and order management cannot be opted out of while your account is active.
13. Live Auction Events
- Live auction events are hosted by individual sellers using video streaming. PorchPickups provides the technology platform but does not control or endorse the content of live streams.
- Users participating in live event chat must adhere to community standards. Harassment, hate speech, spam, and disruptive behavior may result in removal from the event and/or account suspension.
- Bids placed during live events are binding. The same bidding rules that apply to classic auctions apply to live event bidding.
- PorchPickups is not responsible for technical issues, interruptions, or quality problems during live streams.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- PORCHPICKUPS, THRIFT TRADER LLC, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
- OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PORCHPICKUPS IN PLATFORM FEES DURING THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
- PORCHPICKUPS IS NOT LIABLE FOR ANY LOSS, DAMAGE, OR INJURY ARISING FROM TRANSACTIONS BETWEEN USERS, INCLUDING BUT NOT LIMITED TO THE PURCHASE OF DEFECTIVE, MISREPRESENTED, COUNTERFEIT, OR UNSAFE GOODS.
15. Indemnification
You agree to indemnify, defend, and hold harmless Thrift Trader LLC, PorchPickups, and their officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law; (d) any content you upload or transmit through the Platform; or (e) any transaction you enter into with another User.
16. Termination
- You may close your account at any time by contacting admin@PorchPickups.com. Outstanding obligations (unpaid items, pending shipments, owed fees) survive account closure.
- PorchPickups may suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or conduct harmful to other Users or the Platform.
- Upon termination, your right to use the Platform ceases immediately. Sections 8, 14, 15, 17, and 18 survive termination.
17. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict-of-law provisions.
- Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be subject to good-faith negotiation between the parties for a period of thirty (30) days.
- If negotiation fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of Oklahoma.
- CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
- Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction in the State of Oklahoma.
18. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PorchPickups regarding your use of the Platform.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. PorchPickups may assign these Terms without restriction.
- Modification: We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
19. Mobile Applications & App Stores
PorchPickups is distributed as a mobile application through the Apple App Store and Google Play Store in addition to the web at www.porchpickups.com. The following provisions apply to mobile users:
- License grant: We grant you a personal, limited, non-transferable, non-exclusive, revocable license to install and use the mobile application on a device you own or control, solely for personal, non-commercial purposes (other than legitimate seller activity under these Terms).
- App Store rules: Your use of the mobile application is also governed by the rules of the applicable app store. Where these Terms conflict with App Store rules, the App Store rules control. You agree to comply with all applicable App Store terms (the Apple Media Services Terms for iOS users; the Google Play Terms of Service for Android users).
- Apple App Store — EULA: If you accessed the mobile application via the Apple App Store, you acknowledge that these Terms are between you and PorchPickups only, not with Apple, and Apple has no obligation to provide maintenance or support. Apple is, however, a third-party beneficiary of these Terms with the right (and deemed to have accepted the right) to enforce them against you. Any product-liability, IP-infringement, or warranty claim concerning the mobile application is between you and PorchPickups and not Apple.
- Google Play — Google's role: Google is not a party to these Terms and is not responsible for the mobile application or its content. You agree to comply with the Google Play Developer Distribution Agreement.
- Permissions: The mobile application may request the following device permissions: camera (to capture listing photos and host live auction streams), photo library (to upload listing photos), microphone (live auction streams only), location (optional, to surface nearby auctions), notifications (optional, for bid/win/order alerts), biometric authentication (optional, for quicker sign-in), and storage (caching). You may revoke any optional permission at any time via your device settings; some features may not function without the corresponding permission.
- In-app updates: The Android application may display an in-app update prompt and download a newer version through the Google Play in-app updates API. On iOS, you will be directed to the App Store to install updates. Continued use of an outdated version may be restricted if required for security or compatibility.
- Apple In-App Purchase exclusion: All transactions facilitated through PorchPickups are for physical goods and services exchanged between users. Apple's In-App Purchase requirement does not apply to physical-goods transactions under App Store Review Guideline 3.1.5(a).
20. User-Generated Content & Moderation
PorchPickups is a marketplace whose primary content is user-generated: auction listings, listing photos, descriptions, profile content, comments, ratings, written reviews, and messages are created by Users. By submitting content to the Platform, you represent and warrant that you have the legal right to do so and that the content does not violate these Terms or any applicable law.
- Prohibited content (objectionable content): You may NOT submit content that is unlawful, sexually explicit, child sexual abuse material (CSAM), hate speech, harassing, threatening, violent, defamatory, fraudulent, infringing on intellectual property, promoting self-harm, or otherwise objectionable. Listings for the prohibited items in Section 5 are likewise forbidden.
- Pre-publication moderation: Listings, profile content, and live-event streams are subject to automated and manual review. PorchPickups may delay, modify, or refuse to publish any content that appears to violate these Terms.
- In-app reporting: Every listing, seller profile, message, live event, and rating includes an in-app "Report" control. Reports can be submitted with a category (e.g., counterfeit, prohibited item, harassment, fraud, child safety) and a written description.
- 24-hour response commitment: Reports flagged for child safety, threats, or imminent harm are reviewed by PorchPickups administrators within 24 hours. Other reports are reviewed promptly. Where a violation is confirmed, PorchPickups will remove the content and may warn, restrict, suspend, or terminate the responsible account.
- Blocking and muting: Buyers and sellers may block one another (Section 7.4), and any User may report another User. Patterns of blocks or reports may trigger administrative review.
- Child safety (CSAE): PorchPickups has zero tolerance for child sexual abuse and exploitation. Any content depicting, soliciting, or facilitating CSAE will be removed immediately, the account permanently terminated, and the content reported to the National Center for Missing & Exploited Children (NCMEC) and applicable authorities as required by law. To report suspected CSAE on the Platform, contact admin@PorchPickups.com with subject line "CSAE Report" — these reports are prioritized.
- EU DSA (where applicable): Users in the European Union may submit notices of illegal content under Article 16 of the Digital Services Act by contacting admin@PorchPickups.com. Notices must identify the content, location (URL), the reason it is illegal, and the notifier's contact details.
- Appeals: If your content was removed or your account restricted and you believe this was in error, you may appeal by emailing admin@PorchPickups.com within 30 days. Appeals are reviewed by a different administrator than the original moderator where practicable.
